General Conditions of Sale

ARTICLE 1 – definitions

Each term beginning below with a capital letter has the meaning given to it in its definition which appears in this article.

“General Conditions of Sale”: designates this document.

“Site”: designates all the services provided by Mr. Alexis Blond, Alexx Magnetiseur to Users, accessible via the portal www.alexx-magnetiseur.fr.

“Users”: designates any natural person using one or more of the Services.

'Client': means any natural person who wishes to book a service.

'Service': means all the services offered.

'Provider': means Mr. Alexis Blond, Alexx Magnetiseur.

ARTICLE 2 – Scope of application

The purpose of these General Conditions of Sale is to establish the rules that govern the contractual relations between Mr. Alexis Blond, Magnetizer and Medium, Alexx Magnetiseur on the one hand, and on the other hand the customer who makes a purchase/appointment for services via the site.

These General Conditions of Sale apply, without restriction or reservation, to all sessions of the services offered by the Provider: Mr. Alexis Blond, Magnetizer and Medium, Alexx Magnetiseur.

They may be modified at any time by Mr. Alexis Blond.

It is the customer's responsibility to consult them and formally accept them before any appointment request.

The services are provided at 05 rue Henri Barbusse - 26100 Romans-sur-Isère

ARTICLE 3 – Limitation of guarantee 

As part of the services provided at home, or other places, the practitioner, Mr. Alexis Blond, may be required, with the client's agreement, to use any furniture and objects made available by the client for the performance of the session. The choice and purchase of the service offered is the sole responsibility of the client.

Mr. Alexis Blond is not bound by an obligation of results.

The Magnetizer is not a doctor, he does not make a medical diagnosis.

He must respect professional secrecy as well as the Hippocratic oath.

Mr. Alexis Blond does not perform any magnetism sessions on pregnant women, minors unaccompanied by adults, or on disabled people unaccompanied by their legal representative.

Mr. Alexis Blond reserves the right to postpone the requested treatment, and to modify the content of the session according to his feelings before or during the session.

The Client declares to have read these General Terms and Conditions and to have accepted them, before the implementation of the service.

ARTICLE 4 – Price

The prices are expressed net and in Euros. These rates are firm and not revisable during their period of validity, but the Service Provider reserves the right, outside the period of validity, to modify the prices at any time.

The client understands and accepts in their entirety, the General Terms and Conditions of Sale as well as the pricing conditions, when requesting a consultation.

No session is refunded unless it is canceled at the request of Mr. Alexis Blond and it has been paid in advance by the client (remote session).

The payment requested from the client corresponds to the total amount of the service. An invoice can be drawn up by the Service Provider and given to the Client.

Certain services may be subject to a quote that has been previously accepted. Quotes drawn up by the Service Provider are valid for a period of 15 days after their establishment.

ARTICLE 5 – Appointments

Any request for an appointment and agreement made with Mr. Alexis Blond implies full acceptance, without reservation or condition, of the General Conditions of Sale in force on the day of the said order.

Mr. Alexis Blond reserves the right to refuse a consultation request without giving the client any explanation.

When ordering a consultation, the client certifies that they have their free consent, complete the forms in good faith and answer the questions provided by Mr. Alexis Blond, thus allowing the proposed sessions to be carried out.

The client must guarantee the truthfulness and accuracy of the information they provide and must have the legal capacity to contract and use a website.

• Cancellation of Appointments

Mr. Alexis Blond informs the client that making an appointment for a session commits the client from an ethical and moral point of view. All remote sessions must be paid for upon sending the payment link before the session. The client understands that the effective payment of the session thus validates the appointment. An unpaid session will automatically result in the cancellation of the appointment.

The Client may cancel their appointment before it is scheduled, within 48 hours before the appointment.

If the client cancels the session, an email must be sent before the scheduled appointment. You will be offered to reschedule the session for another time slot. If you no longer wish to come, the session will be refunded only if it has been canceled 48 hours before the appointment.

In the event of cancellation of the session due to Mr. Alexis Blond, the session will be fully refunded, if it has been paid.
 

ARTICLE 6 – Payment conditions

Payment for services is made at the client's choice by:

• For a face-to-face service, the price is payable in full and in a single payment at the end of each service, in cash, by check or on the site.

No deposit is required when making an appointment in person by the Client.

• For a remote service, the full payment for the service will be requested before the consultation.

The payment made by the Client will only be considered final after actual collection of the sums due by the Service Provider.
 

The Customer has the right to withdraw from these General Terms and Conditions without having to provide a reason, within fourteen days of the validation of their order.

The Alexx Magnetiseur website uses the Stripe payment platform and cannot be held responsible in the event of a failure of the latter.

ARTICLE 7 – Customer Duty

NEVER STOP MEDICAL TREATMENT WITHOUT THE ADVICE OF YOUR DOCTOR OR YOUR SPECIALIST.

Magnetism and all services offered are part of alternative therapies and should not replace modern medicine, but work in addition.
 

ARTICLE 8 – Right of withdrawal
 

The Customer has 14 days to withdraw from the purchase.
 

8.A - Conditions of the right of withdrawal

In the event of withdrawal by the Customer, a refund of all payments received from the Customer will be issued. And, in any event, no later than fourteen days from the day on which the service provider is informed of the Customer's decision to withdraw from this Contract.

This reimbursement will not incur any costs for the Customer.

It is however acknowledged by the Customer that when the latter exercises his right of withdrawal, all types of advantages (including promotional offers), of whatever nature, which would be linked to the initial purchase for which the Customer would exercise his right of withdrawal, will be automatically cancelled.
 

8.B - Exceptions to the right of withdrawal

The Customer acknowledges without reservation that, in accordance with the terms of Article L 221-28 of the Consumer Code, his purchase is firm and definitive, without the possibility of withdrawal, concerning the following Services, or when the following conditions are met:

The Services fully executed or delivered before the end of the normal withdrawal period (14 days).

Customers acting under the status of professional accept that they cannot withdraw from their order, unless they act as or on behalf of a very small company (less than 5 employees) with a corporate purpose different from that of the company.

Customers accept that in all cases, the Services provided by Mr. Alexis Blond, sometimes begin to be performed before the end of the 14-day withdrawal period.

8.C - Exercising the right of withdrawal

To exercise the right of withdrawal, the Customer must notify the service provider of their decision to withdraw from this Contract, before the expiry of the aforementioned withdrawal period.

Notification may be made by writing on plain paper an unambiguous declaration notifying the desire to withdraw and sent by post to the address:

Please specify the following: indication of the Product or Service subject to withdrawal / date of order / Full name and full address of the Customer; It is also mandatory to sign the letter in the event of notification on paper.

ARTICLE 9 – Provision of Services

The service by the Service Provider will be provided according to the following terms:

Consisting of a magnetism session, between 30 minutes and an hour and a half depending on the service and the Client's needs, carried out at the Service Provider's place of work or any other location, decided by mutual agreement between the service provider and the client.

Consisting of a cleaning and purification session of premises, between one hour and one day depending on the service and the Client's needs, carried out at the location requiring the intervention.

The date and time of the performance of the service are indicated to the Client when making the appointment.

The Service Provider has an obligation of means and not of results.

ARTICLE 10 – Applicable law – Language

These General Terms and Conditions and the operations resulting from them are governed by and subject to French law. They are written in French. In the event that they are translated into one or more foreign languages, only the French text shall be authoritative in the event of a dispute.

ARTICLE 12 – Disputes

The Consumer Customer may, in the event of a dispute arising from this agreement, request recourse to a consumer mediator.

In accordance with Articles L 611-1 to L611-3 and R 612-1 to R 616-2 of the Consumer Code, any consumer has the right to have recourse free of charge to a consumer mediator, with a view to the amicable resolution of the dispute between them and a professional, provided that the consumer-related dispute could not be settled amicably and directly with the professional.
